Exciting updates are coming to the Florida Solicitation of Contributions statutes, and it’s crucial for your organization to stay informed. The Florida Department of Agriculture and Consumer Services (FDACS) has announced important changes effective July 1, 2024.
Key Statute Changes:
Exemption Based on Contributions:
Organizations with total contributions under $50,000 in the previous fiscal year, managed entirely by unpaid personnel, may be exempt from registration fees. An application (FDACS-10110) is still required.
Financial Statement Extensions:
The 180-day extension for financial statements has been removed. Extensions can be requested to match the IRS date by providing relevant documentation. Missing the deadline will lead to automatic suspension of registration. Note: Small charities (under $50,000 in contributions) are not eligible for this extension.
Fee Structure Update:
The $10 fee for organizations receiving less than $50,000 in contributions has been eliminated.
Definition of Street Address:
The term "street address" now excludes virtual offices, post office boxes, and mail drops. This clarification applies throughout the statute.
